1) Success-fee recruitment

As a recruitment agency, we manage your one-time hiring needs from sourcing to closing. We operate on a retainer basis to ensure mutual trust and commitment.Our fee is 25% of the agreed gross annual salary or 15% of the total invoice excluding VAT.

2) RPO service

With an RPO model, we handle your recruitment processes on your behalf, establishing a long-term partnership. This is an excellent way to strengthen your employer brand !The fee is $500/day excluding VAT, with a minimum of 2 days/week over two months.

3) Training & consulting

Because outsourcing recruitment is not always the best option, we also offer training and consulting to guide you through this critical journey.The fee is quoted based on €200 excluding VAT per hour. A framing meeting is required.

Terms and Conditions of ServiceThese general terms and conditions (hereinafter referred to as the “Terms and Conditions”) are entered into between :Dear Spark, a micro enterprise managed by Nina Desmeulles registered in France with the RCS of Caen under SIRET number 815 110 002 000 20 (hereinafter: the “Company”).AndOur Clients and Candidates.PREAMBLE
Welcome to Dear Spark, a recruitment agency specializing in sourcing top-tier talent for tech and luxury companies. Our mission is to connect leading organizations with exceptional professionals, offering personalized recruitment solutions tailored to the unique needs of the tech and luxury industries. By engaging with us, you agree to the terms outlined below, which govern the provision of our recruitment services. We strive to create a seamless, efficient, and transparent process for both our Clients and Candidates. Please take a moment to read and understand these terms.
I – DEFINITIONS
Client : Any company or organization that seeks recruitment services to hire a Candidate.
Candidate : Any individual seeking employment through our recruitment services.
Placement : The successful employment of a Candidate by a Client, either temporarily or permanently.
Services : All recruitment-related activities provided by the Agency, including sourcing, interviewing, and referring Candidates for Clients.
II – SERVICES PROVIDED
We offer recruitment services, including :
Sourcing and screening Candidates for permanent, temporary, or contract positions.
Coordinating interviews between Clients and Candidates.
Providing additional services as requested, including candidate background checks and skill assessments.III – CLIENT RESPONSIBILITIES
Provide accurate and up-to-date job descriptions, salary expectations, and any other relevant details necessary for the recruitment process.
Inform the Agency promptly of any changes to job requirements or hiring preferences.
Ensure that their hiring practices are non-discriminatory and comply with applicable labor laws.
IV - CANDIDATE RESPONSABILITIES
Provide accurate information regarding qualifications, work history, and personal details.
Attend scheduled interviews and inform the Agency promptly of any changes in their availability or status.
Notify the Agency immediately if they accept or decline an offer from a Client.V - RECRUITMENT FEES
Fee Structure : The recruitment fee will be 25% of the Candidate's first-year salary (15% of the Freelance total invoice, excluding VAT), or a fixed fee depending on the specific arrangement.
Payment Terms: The fee is due within 30 days of the Candidate's acceptance of the offer or commencement of employment. Late payments will incur a penalty of 10% per month.Refunds: In the event the Candidate leaves the Client’s employment within 90 days, the Agency will provide a replacement Candidate at no additional charge.VI - Payment terms
The Client agrees to pay the recruitment fees as outlined above.
Payments should be made by bank transfer and are due within 30 days from the invoice date.Failure to make payment on time may result in legal action.VII - Confidentiality
Both parties agree to maintain confidentiality regarding all confidential and proprietary information, including Candidate details and Client information.
The Agency will comply with applicable data protection laws, including GDPR (if applicable), in the handling of personal data.VIII - REPLACEMENT POLICY
If the Candidate leaves the Client’s employment within 90 days of the start date, the Agency will provide a replacement Candidate free of charge, subject to the Client notifying the Agency within 7 days of the Candidate’s departure.
IX - LIMITATION OF LIABILITY
The Agency will not be liable for any loss, damage, or injury arising from the employment of a Candidate.
The Client is responsible for conducting final interviews and determining the suitability of any Candidate.The Agency’s total liability will be limited to the recruitment fee paid for the placement.X - NON-SOLICITATION
The Client agrees not to directly hire any Candidate referred by the Agency for a period of 12 months after the initial introduction or placement, without paying the agreed-upon recruitment fee.
XI - TERMINATION
Either party may terminate this Agreement with written notice if the other party breaches any material term of this Agreement.
Upon termination, all outstanding payments must be settled.XII - DISPUTE RESOLUTION
In the event of any dispute arising out of or relating to this Agreement, the parties agree to attempt to resolve the matter through informal negotiation.
If a resolution cannot be reached, disputes will be settled through mediation or arbitration, as agreed by both parties, and governed by the laws of France.XIII - FORCE MAJEURE
Neither party will be held liable for failure or delay in fulfilling obligations under this Agreement due to causes beyond their reasonable control (e.g., natural disasters, pandemics, etc.).
XIV - AMENDMENTS
Dear Spark reserves the right to modify or update these Terms and Conditions at any time. Any changes will be communicated to the Client and Candidate, and continued use of our Services will indicate acceptance of the revised terms.
XV - ACCEPTANCE OF TERMS
By engaging Dear Spark’s recruitment services, the Client and Candidate agree to these Terms and Conditions.
